TERMS AND CONDITIONS (MEMBERSHIPS)

This is to bring to your awareness that after booking an appointment, you acknowledge that you have understood and agreed to the terms and conditions of Nikhil Sharma Hairdressing. Nikhil Sharma Hairdressing has the right to delay, cancel, shorten or change services where it deems reasonable and necessary as a result of the details given below. When you visit our website, avail our services or make a transaction on it, you agree to be bound by terms of its use as in force from time to time. Please read these carefully. Our Services are quite varied; so on various occasions additional terms may apply. Additional terms will be applicable for the relevant Services, and those additional terms become part of your agreement with us if you use those Services.

BOOKING APPOINTMENTS:

1. Nikhil Sharma Hairdressing is a busy salon so to keep the schedule seamless we prefer prior appointments so as to avoid any disappointment, booking of the services in advance is necessary for people holding memberships of the salon as well. Booking will then be confirmed by the staff members.

2. There will be no appointment reminders, and cancellation of the appointment shall be made a day prior to the time slot provided to you. If there is booking without cancellation that results into no-show of the customer, 50% amount of the service booked through membership will be deducted.

3. There may be times when it will be us who have to cancel your appointment in case of absence of staff member due to any unforeseen circumstances/illness or emergencies.

4. Any delay from our end will be communicated and will not result into any refunds. If you have agreed to the delay, no complaints for refunds will be entertained

5. If we are not able to reschedule the appointment at any other time slot with another staff member as per your wish, on the same day we will need to cancel the appointment and rebook for the next available appointment.

6. We will notify you as soon as we have any information if we need to cancel your appointment through our end.

7. Membership overall can only be cancelled under the condition that it is cancelled within 24 hours of purchase of the membership, provided that no services have been availed of the membership.

8. If a member seeks a specific staff or artist for their required services, his/her booking is also subject to availability and not on priority basis.

9. All credit and debit cards are accepted as modes of payment and all the prices included value added tax at current rate. Payment shall be done right after the services are availed at the same centre where the services are availed or products are purchased.

10. In case the bill is not shared immediately, the bill will be shared electronically within 24-48 hours since it is generated through software that can cause delay as errors are common in processing of producing receipts. If this situation arises, and the bill is not handed immediately, does not equate to services being free of cost.

TIME OF ARRIVAL:

1. In case you have arrived early, please be prepared to wait until your booked appointment time, provided that the staff member is busy with other appointments/work, in the case the staff member is free we will be happy to accommodate your service.

2. Maximum waiting time will only be 15 minutes, unless told otherwise about any delay. Post the waiting time of 15 minutes we will take the service of our next guest.

MEMBERSHIPS:

1. We provide different categories of memberships, with membership privileges increasing the higher you go

2.  Each membership stands valid for only 1 year from the beginning of your membership.

3. While purchasing a membership, you pay a lump sum sum amount and the GST is not added on top of that. the GST amount is already included within the amount you pay, however while availing any kind of services through membership, GST will also be added to the bill of the services availed. Total amount will be calculated to SERVICES+GST at the time of billing despite paying GST while purchasing the memberships. GST will be applied during both purchasing of the membership and redemption.

4. Membership benefits cannot be exchanged for any cash/ gifts/ any other ongoing offers.

5. Membership fee is completely non-refundable.

6. Membership can be shared between family members and friends, if the member wishes to book services of the membership for someone other than themselves, it is mandatory to book through the registered mobile number used for purchasing the membership at NSH.

7. Each of the memberships has a different set of offers and discounts and cannot be mixed through negotiations.

8. Purchasing a membership does not equate to having priority at the salon, and the services will be subjected to availability.

9. The benefits of the membership cannot be combined with any other separate ongoing promotions or offers.

10. Benefits of memberships, if remaining, cannot be availed once the membership has expired and neither will there be any refunds of the remaining amount.

11. Memberships are not transferable to another individual but can be shared with family/ friends.

12. Members are strictly required to disclose any medical allergies or skin/ hair conditions before the service, any staff member will not be liable for any adverse effect of any product on skin/hair.

13. Dissatisfaction of any kind on any services will not be eligible for any refund. While we try our best to give the best services, your cooperation is necessary in knowing that it is the art of human hand and mistakes are inevitable. We value our customers and will only be able to provide the best instant solution to match your expectations. Any errors can only be corrected through available measures but cannot result into re-service.

14. By agreeing to these terms and conditions, you also agree to permit for publishing any image taken at NSH, any image taken at NSH are owned by NSH and are protected by Intellectual Property Laws.

15. Termination of membership in rare cases is possible without any refunds. Purchasing of membership does not allow members to misconduct or misbehave with any staff members. Violating any terms can result into forfeiture of unutilized benefits.

16. To the fullest extent allowed as per law, NSH or any staff member of NSH is not liable for any loss, damage or injury beyond direct refunds or re-services for errors where necessary.

17. These terms are governed by Indian Law, and fall under Haryana Jurisdiction. Disputes of any kind will be attempted to be resolved via direct negotiation and mediation before litigation.

18. We reserve the rights to update these terms and conditions; the latest version applies immediately. It is the customer’s sole responsibility for regularly reviewing the terms and conditions before any complaints about changes.

19. Other than as expressed out in these terms and conditions, neither NSH nor its suppliers or associates make any specific promises about the services. The services remain on an ‘as is’ basis and we do not make any commitments or assurance about the services or their reliability, availability or ability to meet your needs and expectations.

20. While some jurisdictions provide for certain guarantees and warranties, ex: implied warranty of merchantability, fitness for a particular purpose and non- infringement, to the extent that is permitted by law, we exclude all guarantees and warrantees.

21. These terms do not grant you the right to use any branding or logos used in our Services. Don’t remove, obscure, or alter any legal notices displayed in or along with our Services.

22. You shall indemnify, keep indemnified and hold harmless NSH, its agents, associates, affiliates, directors, officers, employees, subsidiary companies from any claim, demand and action relating to or arising out of your breach of Terms of Use, violation of any law, rules and regulations or rights of third party.

23. A customer or member will be blacklisted by NSH for any reason and not limited to them being aggressive, misbehaving, intimidating and threatening any team member of the company or other guests at the store. Also in case if any way a member or customer causes harm to the good name of the brand NSH or causes harm or who is cited for infraction of rules and regulations will also be blacklisted. A blacklisted customer or member will be liable for all amounts pending against active invoices or services rendered and any prior paid membership fee shall be forfeited. Blacklisted customer/member will be denied service and membership in any or all of our stores anywhere in the country.

24. Rights of Admission are reserved. The Management has the right to reserve service to selected customer and has the rights to refuse any client at their sole discretion and modify the services. For e.g.: In case of any delay in check-in by customer for appointment, we have rights to modify the appointment as per standard operating procedure.

25. If there is a conflict between these terms and the additional terms, the additional terms will supersede for that conflict.

26. If you do not comply with these terms, and we don’t take action right away, this doesn’t mean that we are giving up any rights that we may have (such as taking action in the future). If it turns out that a particular term is not enforceable, this will not affect any other terms.

27. In case of force majeure or any other reasons (including but not limited to – Pandemic, Epidemic, Flood, Earthquake, Hurricane, War, etc.), if the stores are closed or forced to remain closed, there will be no refund of membership fees. The Brand is not liable to repay or extend membership duration.

28. In the event of the death of a member, no refund will be issued. The membership will be transferred to the next living relative or heir of the deceased member, unless that person has been blacklisted by the Brand, in which case the membership will be terminated

29. In case of any dispute regarding membership, the matter will be referred to an arbitrator chosen by the Management. The arbitrator’s decision will be final and binding.

30. These provisions are severable; if any provision is determined to be illegal or unenforceable, the remaining provisions shall continue to be enforceable. Failure to exercise any remedy or right in this contract shall not be construed as a waiver.

31. In the event any legal action, claim, or proceeding is initiated by the Member against the Company, all legal costs, expenses, and government fees incurred by the Company in defending such action shall be fully borne by the Member.

32. When permitted by law, NSH and NSH suppliers and all its associates, will not be responsible for loss of profits, revenues, or data, financial losses or indirect, special, consequential, exemplary, or punitive damages or charges, costs, expenses, obligations and liabilities of any kind.

33. To the extent permitted by law and proved to be so, the total liability of NSH , and its suppliers and associates, for any claims under these terms, including for any implied warranties, is limited to the amount you paid us to use the Services (or, if we choose, to supplying you the Services again).

34. In all cases, NSH, and its suppliers and associates, will not be liable for any loss or damage that is not reasonably foreseeable.

35. Children below the age of 18, who wish to be a part of any memberships shall be strictly under the authority of their respective guardians.

36. In case any member wishes to personally consult with Artist Nikhil Sharma, it will be subject to availability, although we care deeply about our customers, arrangements through phone calls can be made, also subject to availability.

37. NSH has employed CCTV surveillance across the salon for safety of patrons and staff and is not permitted to be shared with anyone other than a legal court order.

38. Delay in service through our end- in case of booking for special events such as marriage or photo shoot, job interview or any kind of professional or social commitments made post the service results into delay in your presence of those commitments is strictly not our skill issue or responsibility, rather only an inevitable malfunction due to any state emergencies, power cuts or power back up issues, or any medical emergencies of any staff.

COLLECTION AND USE OF INFORMATION:

1. NSH is permitted to gather personal information that is provided by the member while availing of the services or purchasing of membership. Our motto is to provide a smooth, hassle-free and safe experience to each customer and your information allows us to provide services and features that are most likely to meet your utmost expectations and also enables a user friendly and easy experience.

2. While registering with us, collection of your personal information like name, address, email id, mobile number, birth date and gender is permitted.

3. We also collect information about your transactions, use of our services, your preferences etc.

4. If a member has agreed to receive emails of any offers or promotional emails, those are going to be unsolicited and are likely to become public. In that case, NSH will not be held liable or responsible for the usage or misuse of your personal information. While personal information will not be disclosed by us first hand, NSH will not be responsible for any hackers trying to obtain personal information through our data.

5. When you make a transaction with us, information about your debit/credit card, its expiry and other instrument details are collected. It also allows us to know your buying behaviour and preferences.

SHARING AND DISCLOSURE OF INFORMATION:

1. NSH respects your privacy and does not offer, sell or share your personal information with others or non affiliated companies except to provide services or products you have requested and with your consent and in following instances:

2. We provide information to our business partners who work for or on behalf of NSH under confidentiality obligations. They may use your personal information to inform you about services or products offered by them or NSH.

3. In any case if the member provides any personal information to any staff member on a one on one basis, any misconduct will not be a responsibility of NSH and will be treated as a personal relationship of the staff and member.

4. In the case of any response to a court order, or judicial authority, government offices and officials requiring your personal information, is permitted to be shared by us for their official duties.

5. For prevention of any illegal activity, or suspicion of fraud, or any scenario involving any kind of threat to any individual, violence or abuse of NSH’s privacy policy or terms of use, such personal information can be shared, as to maintain our good faith.

6. If NSH is acquired by or merged with other entity, such information will be transferred to other entity which will be intimated to you.
